Why Fire Safety Compliance Matters

Your legal duties under fire safety law

The introduction of the Regulatory Reform (Fire Safety) Order 2005 replaced all previous fire legislation.  Under the order, it is a legal requirement for the Responsible Person — usually the employer, building owner, or occupier — to ensure a suitable and sufficient fire risk assessment is carried out for almost all non-domestic premises in England and Wales.


This legislation applies to a wide range of buildings and structures, including:


  • Offices, shops, and commercial premises
     
  • Industrial units, factories, and warehouses
     
  • Public buildings and community centres
     
  • Schools, hospitals, and care homes
     
  • Places of worship and entertainment venues
     
  • Communal areas of residential buildings (e.g. blocks of flats, HMOs)
     

It does not apply to individual private homes or flats, though landlords and managing agents are legally responsible for shared areas such as stairways, corridors, and entrances.


Following the enquiry into the Grenfell Fire new legislation and amendments to existing regulations are helping to pave the way for a more efficient and competent approach to fire safety. The building safety reforms, including the Building Safety Act introduce a new regulatory framework aimed at improving building safety, particularly in high risk or high rise buildings.


Fire risk assessments are a mandatory requirement which will have to be reviewed regularly and whenever significant changes have been made that would have an impact on it,  and failure to comply can lead to enforcement notices and fines. So, it’s good business sense as well as a legal requirement.

Recent Legal Changes You Should Know

The Fire Safety Act 2021 confirms that flat entrance doors and the external walls ( including anything attached to the exterior of those walls) in any building containing two or more domestic premises must be included in the fire risk assessment. 

 

The Fire Safety (England) Regulations 2022 require:
 

  • Quarterly checks on communal fire doors in buildings over 11m
     
  • Annual checks of all flat entrance doors (on a best endeavours basis)
     
  • Clear information provided to residents about fire doors and their role in safety


The Building Safety Act 2022 introduces new duties for the management of fire and building safety in High-Risk Residential Buildings.


It applies to all new buildings, although it does include a number of specific additional requirements for those classed as Higher-Risk Buildings
