Your Legal Responsibilities

Understanding the duty to manage asbestos

The Control of Asbestos Regulations (CAR) 2012 places a legal duty on those responsible for non-domestic premises—such as landlords, facilities managers, and property owners—to assess, manage, and mitigate the risks associated with asbestos.


Under Regulation 4 of CAR 2012, you must:


  • Identify and assess asbestos-containing materials (ACMs) in your premises
     
  • Presume materials contain asbestos, unless there is strong evidence to suggest otherwise
     
  • Create and maintain a written asbestos register, detailing the location and condition of any ACMs
     
  • Develop and implement an asbestos management plan, outlining how the risk will be controlled
     
  • Inform anyone working on or around the premises—including contractors and maintenance staff—about the presence and condition of ACMs
     

Failure to comply can lead to serious health risks and legal penalties, including fines and prosecution.
